Responsibilities
Incumbent serves under the general supervision of the Staff Judge Advocate for the Commandant, USMC, while providing legal advice and representation to active duty military families enrolled in the Exceptional Family Member Program (EFMP) throughout the Marine Corps Installations, Pacific region. Incumbent is located at and under the direct supervision of the legal assistance office at Marine Corps Base Hawaii.Incumbent performs the duties described herein, and other duties as assigned. Incumbent’s primary duty is to provide advice and legal representation to active duty EFMP families seeking educational and support benefits from federal, state and local resources for their family member with special needs. Incumbent’s duties include advocating procedural and substantive issues under applicable Hawaii and federal education and disability laws and regulations, including due process hearings, and, if necessary, Hawaii courts. Incumbent will also represent families in various administrative proceedings to obtain state support benefits related to individuals with special needs.Incumbent will coordinate access to pro bono legal representation as necessary, including for those practice matters that would require representation against the United States. Incumbent will also draft special needs trusts and provide other legal assistance services in support of EFMP families who are stationed within Marine Corps Installations, Pacific area of responsibility.Incumbent will, as a secondary duty consistent with the Marine and Family Programs Division Warfighter and Family Support mission, and as directed, provide general military legal assistance services to active duty and retired members of the U.S. Armed Forces, their dependents, and other persons entitled to such services as established by federal statute or regulation. Legal issues will range from simple to complex matters involving, among others, domestic relations and family law, economic and consumer affairs, deployment and mobilization preparation, and preventive law.Incumbent will coordinate as needed with the attorney, Marine and Family Programs Division (MF), Headquarters, USMC, for EFMP legal issues and access to pro bono services related to educational and support services. Incumbent will also coordinate as needed with the Judge Advocate Division (JLA), Headquarters, USMC, for the providing of special needs related to legal assistance services.

Qualifications
Incumbent is a U.S. citizen and an active member in good standing of the bar of the State of Hawaii and admitted to the highest court of Hawaii. Due to the nature of incumbent’s duties, admission to practice before the United States District Court, Hawaii is required within 6 months of hiring. Experience with educational or disability law is preferred. Familiarity with the Marine Corps is desirable.
